Summary of Issue

Footnote Number 5 for driver's record of duty status when driving in Canada relative to applying the 14 consecutive day, 120 hour rule requires a revision to reflect the correct application of the 75 hour rule. The footnote indicates a 24 consecutive hours of off duty must be taken prior to accumulating 75 hours of on duty time. The requirement to have a 24 consecutive hours off-duty must be taken prior to accumulating more than 75 hours of on-duty time.

Justification or Need

This issue requires to be addressed immediately as placing a driver out-of-service or issuing a ticket when a driver has not reached the 75th hour of on-duty time for not having the 24 consecutive hours off-duty would be contrary to the legislation.

Request for Action

Recommend the footnote be revised to: When applying the 120 hours in 14 consecutive day period, drivers must take 24 consecutive hours off-duty prior to accumulating more than 75 hours on-duty.
