Summary of Issue

It is commonly accepted that many motor carriers, vehicle operators and even drivers misunderstand the proper intention and use of the out-or-service criteria. As the availability of the document becomes more prevalent and in the interest of highway safety, it becomes critically important to ensure that such misunderstanding is avoided. It is proposed that a preface be inserted into the document to clarify the correct understanding and use of the criteria.

Justification or Need

Use of the criteria as an operational or maintenance standard can result in vehicles being driven or operated, which fail to comply with applicable safety regulation, and in a condition that approaches an imminently hazardous condition. Providing a clear explanation of the intended use of the OOSC will help to avoid such improper use and demonstrate diligence on the part of CVSA.
