| Summary of Issue | Request to change certain Part 392 violations from SafetyNet Category "other driver" to "traffic enforcement". Sections to be considered: 392.10(a)(1), 392.10(a)(2), 392.10(a)(3), 392.10(a)(4). (all relating to failure to stop at railway crossings) |
| Justification or Need | Many states have geared their CVSPs to concentrate on moving traffic violations as the basis to conduct inspections. These railway crossing violations are clearly traffic law oriented. Supervisors have asked for this change so cites for these violations will show up on various reports as traffic enforcement. |
| Request for Action | Re designate these sections as "traffic enforcement" category 12 items in SafetyNet adn ASPEN. Also, have FMCSA make the necessary software changes. |
