| Summary of Issue | Currently, Operational Policy 5 instructs an inspector to place a commercial motor vehicle out of service for a single violation of 396.7 when the vehicle has significant disabling damage beyond repair (fire). As of now, 396.7 is not an out-of-service condition in the out-of-service criteria. |
| Justification or Need | Adding the 396.7 as an out-of-service condition will allow inspectors to document a single violation per unit that has sustained significant damage beyond repair as a result of the crash. |
