Summary of Issue

CVSA committees routinely take an unreasonable and unjustifiable amount of time to issue decisions, guidance, or resolutions on submitted regulatory issues. There are documented cases that have remained open and unanswered since 2020, and in some instances as far back as 2011. These delays render the submission and review process ineffective. A regulatory body tasked with promoting uniformity and clarity in enforcement cannot function when issues remain unresolved for years, or over a decade, while enforcement continues in the field. At that point, the committee may as well take no action at all.

Justification or Need

CVSA committee decisions carry significant weight and directly influence enforcement practices nationwide. Regulations and interpretations are time-sensitive by nature. When guidance is delayed for years, inspectors continue enforcing inconsistently, carriers and drivers continue to be penalized, and the original purpose of committee review is defeated. The current pace of committee action undermines confidence in CVSA’s governance process and allows known enforcement problems to persist indefinitely without accountability.

Request for Action

REQUEST FOR ACTION - Establish and enforce mandatory timelines for committee review, deliberation, and final determinations. - Require public status updates for all open issues exceeding one year. - Automatically escalate or close issues that remain unresolved beyond a defined timeframe. - Acknowledge and address the existing backlog of issues dating back to 2020 and earlier. If CVSA intends for its committees to maintain credibility and ensure uniform enforcement nationwide, regulatory determinations must be issued within defined, enforceable and reasonable timeframes, not left unresolved for years while inconsistent enforcement continues unchecked. Without timely action, CVSA’s influence on uniform enforcement becomes purely theoretical. Decisions issued years late do not guide enforcement, they legitimize inconsistency and erode confidence in the process.
