| Summary of Issue | There is no violation currently in the FMCSA table of violations for an inoperable emergency/parking brake lamp on the dash to indicate the brake is set. 49 CFR 571.105 S5.3 and 5.3.1 requires the lamp. 49 CFR 393.41 and 393.51 requires the brake system comply with the FMVSS. |
| Justification or Need | Since the lamp is required by FMVSS and the CFR requires compliance with the FMVSS, there should be a specific code for the violation. Currently the only viable options seem to be 393.40(a) and 393.41, but they aren't as specific as they could be if a new code was added for the parking/emergency brake lamp. |
