| Summary of Issue | Conspicuity Tape - FMVSS 571.108 Conspicuity Tape and FMCSR 393.11 393.11 and the ETA Packet published by FMCSA both support the requirement that only 2 pieces of conspicuity tape on each side of the trailer 12 inches long at the top of the trailer at the rear are permitted. NHTSA issued an interpretation in 1994 that clearly stated that 2 pieces 24 inches long on at the top rear of the trailer that follow the contour of the trailer is equivalent to 2 pieces 12 inches long on each side at the top rear of the trailer. |

| Request for Action | Issue an inspection bulletin notifying the lead MCSAP Agency of each state of this requirement. Petition FMCSA to update the requirements in 393.11 and the ETA packet clearly state that 1 piece of conspicuity tape 24 inches in length on each side at the top of the trailer at the rear is permissible. |
