Summary of Issue

Under the 2025 OOS criteria part 1section 4(b)(5) it requires inspectors to place drivers OOS when they have incorrectly self-certified and do not have a valid medical certificate in possession or on file at the time of stop. I believe this section needs to be removed. Starting April 1st If the driver has no medical certificate on file with the state or if a driver cannot provide proof of a valid medical certificate before the completion of the inspection, we will place them OOC with no prior history needed. Therefore section 4(b)(5) would be a duplicate code. I would also like to Include that the fact that the driver not self-certifying correctly is administrative issue and does not meet the definition of an imminent hazard as defined in the 2025 OOSC

Justification or Need

This will cause confusion for inspectors of which codes need to be cited roadside. By removing this code now that it is covered under the new part 1 section 4(b)(3) it will enhance consistency nationwide.

Remove section 4(b)(5) from the OOS Criteria
