| Summary of Issue | We are discovering more and more ELDs that have been altered or manipulated. One of the indicators for an altered RODS is duplicate sequence numbers in the ELD. According to 395.38 4.4.4.1 sequence numbers are not supposed to duplicate. When you see duplicate sequence numbers, it is a big indicator that the RODS has been altered. Sometimes the inspector cannot get the driver to provide the evidence needed to write a false log even though the inspector knows the RODS has been altered. |
| Justification or Need | By adding a 395.20(b) for this violation (Non-OOS), the carrier will know the RODS has been altered and is not in compliance. It also helps the roadside inspector when looking up previous inspections that they need to focus on getting all supporting documents since there is a history of altered RODS. This will also assist the investigator who is doing a compliance review on the carrier what RODS need to be reviewed and what supporting documents they need to ask for. |
