OOS Criteria Driver - 4. Driver Medical / Physical Requirements b. Medical Certificate (4): The wording of this criteria is poor and leads to confusion as to how to accurately apply the OOS violation.

Justification or Need

Current verbiage leads inspectors to believe there are two possibilities for OOS for a property carrier if they have no medical tied to their license as well as if they have a history of violation of this matter. This is not correct and by modifying verbiage to the proposed wording, there leaves no room for misinterpreting that it is only one possibility for OOS and the property carrier must have no medical on file AND history of violation.

Request for Action

Re-word / proposed write up: "Operating a property-carrying vehicle without a valid medical certificate in possession or on file with the state driver's licensing agency and has a previous history of either failing to produce a medical certificate or having an expired medical certificate. (391.41(a)) Declare of out service."
