| Summary of Issue | Modify/update the verbiage found in 393.88 in the regulation to be in line and be applicable to many viewing devices in use today. |
| Justification or Need | 393.88 currently targets "television receiver", etc, capable of receiving a television broadcast. Many devices today are capable of receiving broadcasts of public television, pre-recorded movies, or subscription movies. The current verbiage is archaic. Webster dictionary states, in part, ".....device designed to receive and convert incoming electrical signals into a series of visible images on a screen......". It further states signals are converted from electrical images, transmitted by UHF or VHF radio waves, and then reconverted into optical images. Furthermore, a "broadcast", when defined in association with a television, has the definition of "a single radio or television program". |
| Request for Action | As previously stated, many devices today are available to receive a "television broadcast"; however, this regulation should be broadened with verbiage to include any device capable of receiving/viewing television broadcasts, pre-recorded movies; movies contained on DVD, and movies/entertainment programs as a result of a subscription purpose. I also understand with the existing language involving the definition of "texting", there is associated also with "What is not texting", and I believe there could be specific language to address 393.88. |
