| Summary of Issue | Driver asked me a question: I’m at a State roadside rest stop. I’m on my 10 hour break, in the sleeper, late afternoon. Law Enforcement bangs on the truck, gets me up and says they are going to do a Level 1 inspection. What do I do? Can I tell him I’m on my break, leave me alone. I have done that and they said too bad we are doing the inspection (KY, LA, GA in particular). Doing an inspection, I have to go On Duty. This destroys my break. What can I do? That’s from a discussion with a particular driver. I have talked to other drivers about this and they say it’s pretty common. What options does a driver have? |

| Request for Action | This practice by law enforcement ruins a drivers break. Complicates Motor Carrier scheduling and impairs the driver's ability to meet personal financial needs as well as the Motor Carrier's. Please review this practice. It would be good to prohibit law enforcement from interrupting a driver's break. A driver is obviously at a rest stop for a break of some kind. |
