Summary of Issue

The Colorado State Patrol is requesting a waiver from the CVSA Operations Policy 6 requirement that requires PBBT Instructors to be a certified PBBT for two years prior to being certified as a PBBT instructor qualified to train and certify other inspectors as PBBT operators.

Justification or Need

The Colorado State Patrol began its PBBT program in July of 2017 when it purchased and received its first PBBT device. In order to properly staff the program and have CMV inspectors who are trained and certified to operate the PBBT, the Colorado State Patrol must first develop PBBT instructors who can train and certify other inspectors to be certified PBBT operators. The Colorado State Patrol will initially conduct a train-the trainer training that will take place in October of 2017 with the assistance of the PBBT vendor (Vehicle Inspection Systems Incorporated) and the Kansas Highway Patrol, on behalf of CVSA. Following the train-the-trainer training, it will not be feasible to require PBBT instructors to have two years of experience before they can train other inspectors to be certified PBBT operators. The two-year requirement will delay the development of our program and use of our PBBTs. The Colorado State Patrol intends to certify several inspectors to be certified PBBT operators. Without the waiver our PBBT instructors cannot certify others. As such, we are requesting a waiver of the two-year requirement. The waiver would enable the Colorado State Patrol to designate PBBT instructors to train other inspectors to be certified PBBT operators without the two-year requirement. Following the initial implementation of our program and the expiration of the waiver, if granted, the Colorado State Patrol will follow the current CVSA Operations Policy as written regarding the development of any future PBBT instructor.

Request for Action

The Colorado State Patrol requests a waiver from CVSA Operational Policy 6 to develop certified PBBT instructors by waiving the requirement that PBBT instructors be required to be certified PBBT operators for two years before becoming a certified PBBT instructor. Doing so will allow the Colorado State Patrol to develop PBBT instructors and train and certify other inspectors in the use of the PBBT. The Colorado State Patrol requests that the waiver be for a period of two years from the date the waiver is granted.
