| Summary of Issue | To whom it might concern: During a Level I Driver/Vehicle Inspection (see attachment #1) we were issued an "out of service" violation - 395.8E. Our driver, Mr. Nicolae Nicolaescu challenged the violation in front of the Schenectady City Court and he was granted a non guilty verdict by the Honorable Mark W. Blanchfield (see attachment #2). Since than, we have contacted the New York State Department of Transportation via DataQ in attempt to remove the violation from our company record. So far, we are unsuccessful in convincing the authorities to change their record to reflect the decision of the court.Hence, we beseech your help in removing this out service violation. | Justification or Need | TAG Trans safety record is important both for obtaining customers and attracting responsible drivers. Furthermore, maintaining a good safety record is prerequisite for retaining a valid US DOT registration. |
