| Summary of Issue | The definition of radioactive material in the Federal Motor Carrier Safety Regulations (FMCSR) found in 49 CFR 397.65, does not match the definition of a radioactive material as defined by the Pipelines and Hazardous Materials Safety Administration (PHMSA)found in 49 CFR 173.403. PHMSA changed its definition of a radioactive material in 2004 to bring the definition in line with the International Atomic Energy Agency's (IAEA) definition. |
