| Summary of Issue | The FHWA maintains jurisdiction of the size and weight plan and has the authority to penalize a sate for not enforcing the laws. They claim there is funding for law enforcement but it has to come from Highway Aid money. DOTs dont have the money. |
| Justification or Need | There isa no federal support for size and weight enforcement but a sanction if enforcement is conducted. In most states, this enforcement is conducted by sworn police or peace officers. Need to coordinate between FHWA, FMCSA, DOT's and SPs. |
