| Justification or Need | Several motor carriers have reported that inspectors from several states are demanding that all packages contained in a van type vehicle must be tied down. It was also indicated that there was a situation where the driver was required to tie down the parcels in a delivery van. This enforcement action is apparently based on FMCSR 393.100(b)(1) option A. which indicates that a vehicle must have sides strong enough and high enough to assure that cargo will not shift upon the vehicle. If there is shifting the inspectors are evidently assuming that the cargo should have been secured according to option B. requiring tiedown assemblies. |
