Comments to FMCSA Crash Preventability Determination Program Notice

On Oct. 4, 2019, CVSA submitted (PDF) comments to the Federal Motor Carrier Safety Administration's (FMCSA) notice (PDF) on the agency’s intent to permanently operate a crash preventability determination program. CVSA’s comments outlined concerns that the review process lacks minimum training requirements for the individuals who are making preventability determinations. Additionally, the comments note the negative impact that these determinations could have on pending state criminal or civil proceedings.
